Ahead of the Abuja Federal High Court’s judgment scheduled for November 20, 2025, Nnamdi Kanu, leader of the Indigenous People of Biafra (IPOB), has accused the Attorney General of the Federation (AGF), the Director-General of the Department of State Services (DSS), and two prosecution witnesses of committing criminal perjury during his trial.

Kanu filed the allegations on November 13, 2025, through a direct criminal complaint at a Chief Magistrate Court in the Federal Capital Territory, Abuja.

A statement by Njoku Jude Njoku, Esq., representing the Mazi Nnamdi Kanu Global Defence Consortium, identified the two witnesses as Mr. TAA – Prosecution Witness 1, and Mr. BBB – Prosecution Witness 2.

The complaint, personally signed by Kanu from DSS detention, alleges that the AGF, DSS DG, and the two witnesses engaged in perjury, fabrication of evidence, subornation of perjury, and conspiracy to pervert the course of justice during the ongoing case, Federal Republic of Nigeria v. Nnamdi Kanu (FHC/ABJ/CR/383/2015).

Key grounds of the complaint include:

Perjury by PW1 (Mr. TAA): Kanu claims PW1 lied under oath by denying knowledge of DSS official Brown Ekwoaba, who supervised his detention, interrogations, and alleged torture in 2015. Exhibits submitted with the complaint include affidavits and public service records confirming Ekwoaba’s involvement.

Perjury by PW2 (Mr. BBB): PW2 reportedly falsely stated under oath that he had never met Kanu before the court proceedings, despite leading a video interrogation of him on July 17, 2021. Certified court documents contradict this claim.

Use of Masked Witnesses: The complaint asserts that both witnesses were deliberately masked to hide their roles in Kanu’s interrogations and to suppress evidence about the conditions of his detention.

Criminal Liability of the AGF: Kanu accuses the AGF of suborning perjury by presenting surprise witnesses, relying on statements allegedly obtained under duress, and obstructing disclosure of those involved in his interrogations.

Criminal Liability of the DSS DG: The DSS DG is accused of conspiring to pervert justice by deploying coached witnesses, concealing exculpatory evidence, and enabling false testimony to secure a wrongful conviction.

According to Kanu, these actions violate the Penal Code, the Administration of Criminal Justice Act (ACJA) 2015, and sections 34 and 36 of the 1999 Constitution, which protect against torture, guarantee the right to a fair trial, and the right to examine accusers.

Kanu is seeking criminal committal proceedings and appropriate punishment for PW1, PW2, the AGF, and the DSS DG, and requests judicial acknowledgment that the prosecution’s case was based on fabricated and coerced evidence.

The Mazi Nnamdi Kanu Global Defence Consortium described the filing as historic, noting it is the first instance in Nigeria where a defendant in DSS custody has independently initiated criminal proceedings from detention, providing documentary evidence implicating top state officials in orchestrating false testimony.

“The complaint reveals that prosecution witnesses were manufactured, coached, and deployed to support charges lacking lawful, admissible evidence,” the statement concluded.
