NBA THREATENS LEGAL ACTION OVER EDO JUDICIARY LAW

The Nigerian Bar Association has threatened to challenge the recent amendment to Edo State’s judiciary autonomy law, expressing concerns over its implications for the independence of the judiciary.

The NBA said the amended legislation could undermine the financial and administrative independence of the state judiciary and weaken the principles of judicial autonomy.

The association said it was reviewing the provisions of the amended law and would take appropriate legal steps to challenge any sections considered inconsistent with the Constitution.

The development follows the passage of amendments to the law by the Edo State Government, which has defended the changes and their relevance to the administration of justice in the state.

The NBA maintained that judicial independence is essential to the effective functioning of the justice system and must be protected from political or executive interference.

It also stressed that judges and judicial institutions should be able to carry out their responsibilities without undue influence.

The disagreement has generated concerns among legal practitioners and other stakeholders over the implementation of judicial autonomy in Edo State.

The NBA said it would continue to engage relevant authorities on the matter while pursuing lawful avenues to protect the independence of the judiciary.

The association urged the state government to respect constitutional provisions governing judicial autonomy and ensure that any changes to the law strengthen rather than weaken the justice system.
