BORNO HIGH COURT SENTENCES WOMAN TO TWO YEARS IMPRISONMENT FOR SEXUAL ASSAULT
Chief Magistrate Court in Maiduguri convicts defendant following prosecution evidence of non-consensual physical violation and unlawful assault
A Borno State High Court sitting in Maiduguri has sentenced a woman, identified as Fatima Umar, to two years imprisonment following her conviction on charges of sexual assault and unlawful battery.
The presiding judge delivered the judgment after evaluating evidence presented by the prosecution, which established that the convict engaged in non-consensual physical violation and unlawful assault against the victim.
During the trial proceedings, state prosecutors called key witnesses and presented medical reports detailing the physical harm inflicted during the assault, urging the court to deliver a sentence that reflects the severity of the offense and serves as a public deterrent.
In her ruling, the magistrate held that the prosecution successfully proved the statutory elements of sexual assault beyond reasonable doubt under the applicable penal provisions of Borno State.
The court rejected the defense counsel's plea for a non-custodial sentence, citing the nature of the violation and the importance of safeguarding bodily integrity through strict judicial enforcement.
Legal practitioners and human rights advocates in the state have noted that the conviction reinforces growing institutional efforts by judicial authorities in Northern Nigeria to prosecute gender-based violence and address sexual offenses regardless of gender.
