Former Vice President Atiku Abubakar and the African Democratic Congress have applied to amend their suit challenging President Bola Tinubu’s eligibility to contest the 2027 presidential election.

The Federal High Court in Abuja adjourned the case until October 13, 2026, to hear the application to amend the originating summons. The suit also lists the All Progressives Congress and the Independent National Electoral Commission as defendants.

The case, marked FHC/ABJ/CS/1888/2026, was before Justice Inyang Ekwo. Counsel to the plaintiffs, Joseph Silas, informed the court that the relevant processes had been served on the defendants and that responses had been received.

The application to amend the originating summons was subsequently brought before the court after lawyers confirmed that the defendants had been notified.

Atiku and the ADC filed the suit in August, raising questions over Tinubu’s eligibility for the 2027 election. One of the issues concerns an alleged discrepancy between the name on a National Youth Service Corps discharge certificate submitted to INEC and the President’s official name.

The substantive issues have not yet been determined by the court.

The case had earlier faced a dispute over service of court documents on Tinubu. On September 16, the court granted the plaintiffs permission to serve the President through the APC after they said personal service had proved difficult.

The court will hear the application to amend the suit on October 13.
